Three Albany Teens Arraigned in Bailey Homicide

ALBANY, NY – District Attorney P. David Soares today announced that DEVON CALLICUT, 19, KING MODEST, 17, and RICARDO CALDWELL, 18, all of Albany, NY, were indicted by the Grand Jury on a five-count sealed indictment Friday, September 18, 2009.

CALLICUT was indicted on: (1) count of Murder in the First Degree, a Class “A-1” Felony; (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Violent Felony; and (1) count of Robbery in the First Degree, a Class “B” Violent Felony.

Additionally, CALLICUT, MODEST and CALDWELL were all indicted on: (1) count of Murder in the Second Degree, a Class “A-1” Felony and (1) count of Attempted Robbery in the First Degree, a Class “C” Violent Felony. The defendants were arraigned before the Honorable Dan Lamont this afternoon. All three pleaded not guilty and were remanded into the custody of the Albany County Sherriff.

The indictment alleges that on October 20 th, 2008, around 11:20 p.m., in the area of South Lake Street and Yates Street CALLICUT, MODEST and CALDWELL approached Richard Bailey on their bikes and attempted to rob him with a loaded handgun in CALLICUT’s possession. During the robbery, CALLICUT intentionally shot Bailey in the head, causing his death. Following the shooting of Bailey, CALLICUT robbed another victim at approximately 11:27 p.m., in the area of State Street and Ontario Street, by demanding money after threatening the victim with a pistol.

Chief Assistant District Attorney Dave Rossi is handling the prosecution of the case.
