Witness Intimidator Gets 37 Years

ALBANY, NY – District Attorney P. David Soares today announced that SHAWN ROBERTS, 28, of Watervliet, NY was sentenced to 37 years in state prison by the Honorable Thomas Breslin. In July, ROBERTS was found guilty after a jury trial of (3) counts of Criminal Sale of a Controlled Substance in the Third Degree, a Class “B” Felony, (1) count of Assault in the Second Degree, a Class “D” Violent Felony and (1) count of Tampering with a Witness in the Third Degree, a Class “E” Felony.

Additionally, co-defendant IAN GREENE, 22, of Watervliet, NY, was sentenced to 7 years in state prison by the Honorable Thomas Breslin. In July, GREENE was found guilty after a jury trial of (1) count of Assault in the Second Degree, a Class “D” Violent Felony, (1) count of Tampering with a Witness in the Third Degree, a Class “E” Felony and (1) count of Criminal Possession of a Weapon in the Third Degree, a Class “D”, Violent Felony.

“Successful prosecutions hinge on the ability of witnesses to come forward, be truthful and be confident that their safety is not at risk for assisting law enforcement. These two defendants violated the integrity of the criminal justice process and I am pleased that they will now be spending a very long time in prison for the harm they have done to this witness and our community. The protection of witnesses is the single most important issue for prosecutors and I commend Assistant District Attorney Daniel Lynch for his diligent prosecution of this critical case,” commented DA Soares.

On January 24, 2008, at approximately 11:06 P.M. at 19 Idlewild Park in the Town of Colonie, ROBERTS and GREENE,  assaulted a male victim, stole his belongings and burned his ear with a heated grill fork in an attempt to stop him from testifying against ROBERTS in court.

Additionally, on October 11, 2007, November 5, 2007 and November 9, 2007, ROBERTS knowingly and unlawfully sold the narcotic drug cocaine.
