Jury Finds Albany Man Guilty of Burglary and Gun Possession ALBANY, NY - District Attorney P. David Soares today announced that DANIEL CLINKSCALES, 21, of Albany, NY, was found guilty after jury trial of (2) counts of Attempted Burglary in the First Degree, a Class “C” Violent Felony and (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Violent Felony in front of the Honorable Thomas Breslin. CLINKSCALES faces up to 15 years in prison when sentenced on November 25, 2008. “If you carry a gun in Albany County, there are only two places for you to go – to prison or six feet under. I urge all those young men who are carrying guns today to consider those words and disarm, it is only a matter of time before we find you,” commented DA Soares. On May 21, 2008 at 9:38 A.M. JONES and CLINKSCALES attempted to enter a home and steal property and money from the residents. Officers responded to the scene and JONES pointed a loaded .40 caliber semi-automatic handgun at the officers. JONES and the CLINKSCALES were taken into custody and the gun recovered. On September 18, 2008, QOYA JONES, 20, of Albany, NY, pled guilty to (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Felony in front of the Honorable Thomas Breslin. In accordance with the terms of the plea bargain, JONES faces 10 years in prison and 5 years post release supervision when sentenced in November.
