GUILTY PLEA OF COLONIE JEWELER

ALBANY, NY –Albany County District Attorney P. David Soares announced today that PETER SPINELLI, 50, of Krumkill Road, Guilderland, NY, plead guilty to (2) counts of Grand Larceny, a Class "E" Felony.

In the plea, PETER SPINELLI admits to stealing property from Spinelli Jewelers located at 1315 Central Avenue in the Town of Colonie. On several different occasions SPINELLI is alleged to have sold jewelry to customers that was purported to contain real diamonds when in fact they contained fake stones.

SPINELLI will be sentenced before the Honorable Thomas Breslin in February 2007. In that time, SPINELLI will have to liquidate his assets and repay approximately $200,000 to $400,000. The Defendant will be sentenced for a term of no less than 2 1/2 and no more than 8 years depending on restitution by sentencing; he is out on $40,000 Bail.

District Attorney Soares stated today, "We prosecuted this case on behalf of an honorable profession that relies on the confidence of its customers. Mr. SPINELLI criminally violated the trust of his clients and we hope that this successful prosecution of Mr. SPINELLI helps to restore that confidence."

This case was handled by Assistant District Attorney, Christopher Baynes of the White Collar Unit within the Office of the District Attorney.
