Arraignment of Peter Spinelli

ALBANY, NY –Albany County District Attorney P. David Soares announced today the arraignment of PETER SPINELLI, 50, of Krumkill Road, Guilderland, NY. SPINELLI was arraigned this morning before the Honorable Thomas Breslin on a 20 Count Indictment. The counts range from Grand Larceny (9) in the Third and Fourth Degrees, Class E Felonies, (1) count of Repeated Failure to File Personal Income Tax and Earnings Filings, a Class E Felony and (10) Counts of Petit Larceny, Class A Misdemeanors.

The 20 count indictment alleges that on several different periods of time, PETER SPINELLI did steal property from Spinelli Jewelers located at 1315 Central Avenue in the Town of Colonie. On several different occasions SPINELLI is alleged to have sold jewelry to customers that was purported to contain real diamonds when in fact they contained fake stones. In one instance, the defendant is alleged to have replaced a 73 year old family stone with moissanite when it was entrusted to him for resetting.

In addition, during the taxable years of January 1, 1999 ­ December 31, 2001, SPINELLI is alleged to have evaded payment of tax and failed to file his personal income tax returns with the State of New York for 3 consecutive years.

The Defendant is out on $45,000 Bail. If convicted on all counts, SPINELLI faces 25 years.

District Attorney Soares stated today, "We are going to vigorously prosecute this case on behalf of all of the victims who have been cheated by this man. We are also prosecuting this case on behalf of an honorable profession that relies on the confidence of its customers. Let's remember that Mr. Spinelli stands accused of serious crimes. He is innocent in the eyes of the law and our constitution affords him this presumption. We believe and we intend to prove that Mr. SPINELLI criminally violated that the trust of his clients and we hope that our successful prosecution of Mr. SPINELLI helps to restore that confidence."
