Troy Man sentenced to 15 years
 
Possessed a Toy Gun and sentenced on Armed Violent Felony

ALBANY, NY –  District Attorney P. David Soares announced the sentencing of DANIERE  MATHIS, 38, of 32 Fourth Street., Troy, NY to Robbery in the 2nd Degree, a class “C” Armed Violent Felony, by the Honorable Paul Czajka.  MATHIS received 15 years in State Prison and 5 years of Post Release Supervision. 
 
On July 22, 2005, at approximately 10AM, at 1465 Washington Avenue, MATHIS, did forcibly steal property from the victim, consisting of an ATM card and $300.00 in cash.   MATHIS displayed what appeared to be a pistol and threatened to kill him if he didn’t comply to his demands.   MATHIS had an extensive and violent criminal history.  The gun would later be revealed as a toy.
 
MATHIS was convicted by a jury on June 2, 2006 by Assistant District Attorney Frank Calderone of the Street Crimes Unit. 
 
District Attorney Soares commented after the sentencing, “MATHIS had an extensive and violent criminal history. He threatened the victim with a gun.  Whether or not, this gun was real is irrelevant. MATHIS may have known the gun was fake, but the victim did not and that is what matters here. We will vigorously go after those who are displaying handguns and preying on innocent people.”
