Office of the District Attorney Two Indicted for '07 Christmas Eve Murder of Albany Man ALBANY, NY – District Attorney P. David Soares today announced that MARCUS ROBERTS, 31, of Albany, NY, and RASHAD NICHOLSON, 18, of Albany , NY, were indicted by the Grand Jury on a sealed indictment consisting of (2) counts of Murder in the Second Degree, a Class “A-1” Violent Felony, and (1) count of Attempted Robbery in the First Degree, a Class “C” Violent Felony. Additionally, ROBERTS was indicted on (1) count of Murder in the First Degree, a Class “A-1” Violent Felony. The indictment was unsealed by the Honorable Dan Lamont and both defendants face life in prison without the possibility of parole if convicted of the charges. The indictment alleges that on December 24 th, 2007, at approximately 1:40 P.M., near 53 Second Street, ROBERTS and NICHOLSON attempted to rob Thomas Cichocki and Michael Franklin. During the robbery, ROBERTS shot Michael Franklin with a handgun, killing him. NICHOLSON was arraigned on the charges yesterday, October 13, 2009. The indictment against ROBERTS was unsealed today and the arraignment was adjourned until October 29, 2009 so he can retain private counsel.
