Albany Man Found Guilty of Armed Robbery and Biting Off Ear Gets 32 Years in Prison and an ‘Earful’ from the Judge ALBANY, NY – District Attorney P. David Soares today announced that JERRY CARTER, A.K.A. “Big Man”, 30, of Albany, NY, was sentenced to up to 32 years in prison by the Honorable Thomas A. Breslin. On November 26, 2007, at 195 Clinton Avenue in the City of Albany, JERRY CARTER forcibly stole a gold bracelet from a male victim. During the robbery, CARTER displayed a gun, pistol whipped the victim and caused the victim serious physical injury. CARTER bit off a portion of the victims left ear. “Today it was Mr. Carter that got an earful,” said DA Soares. Upon sentencing, Judge Breslin commented that, “This is as nasty an assault that this court has witnessed in 19 years on the bench.” In August, CARTER was found guilty after a jury trial of eight counts including: (2) counts of Robbery in the First Degree, a Class “B” Violent Felony, (1) count of Robbery in the Second Degree, a Class “C” Violent Felony, (2) counts Assault in the First Degree, a Class “B” Violent Felony, (1) count of Assault in the Second Degree, a Class “D” Violent Felony, (1) count of Criminal Possession of a Controlled Substance in the Fifth Degree, a Class “D” Felony, and (1) count of Criminal Possession of a Weapon in the Third Degree, a Class “D” Felony. Deputy Chief Assistant District Attorney Cheryl Fowler handled the prosecution of this case. ###
