Office of the District Attorney P. David Soares ALBANY, NY –District Attorney P. David Soares today announced the indictment of CANDICE LAMBERT a/k/a CANDICE BIRCH. The Indictment states that CANDICE LAMBERT, 41 of Hollis, NH was indicted on one (1) count of Grand Larceny the Third Degree, a class "D" felony, (1) count of Scheme to Defraud in the First Degree, a Class "E" Felony and (1) Count of Attempting Grand Larceny in the Second Degree, a Class "D" Felony. The LAMBERT Indictment alleges that between February 2002 and April 2002 at the New York State Teacher's Retirement System, located at 10 Corporate Woods Drive, in Albany, NY the defendant did, with intent steal property from the New York State Teacher's Retirement System consisting of an accelerated death benefit in the amount of $111,000.00. In addition, the indictment also specifies that between March 1, 2002 and July 31, 2005, at the Cohoes City School District, 7 Bevan Street, Cohoes, NY, the defendant did steal property in excess of $3,000 from the Cohoes City School by means of using time off from the teachers sick time bank and receiving medical benefits to which she was not entitled to. The Indictment further alleges that between January 1996 through July 2005, at the Cohoes City School District in Cohoes, NY, the defendant did engage in a scheme constituting a systematic ongoing course with intent to defraud more than one person by false pretenses, representations or promises, to the Cohoes City School District and individual teachers fabricating documentation saying she had cancer thereby obtaining money in excess of $1,000 for medical benefits and various time off from a sick time bank donated from the teachers. If convicted on all counts, LAMBERT faces 7-20 years. Arraignment will be Tuesday, October 17th, 2006. No time is available for court schedule at time of release.
