John Evans Faces Prison for DWI

ALBANY , NY – District Attorney P. David Soares announced that JOHN FRANCIS EVANS, 46, of 318 Sand Creek Road , Albany , NY was sentenced today to 1 1/3 rd to 4 years in state prison and a $2000 fine by the Honorable Joseph C. Teresi.

EVANS had pled guilty in a Superior Court Information to one count of Driving Under the Influence of Alcohol as a felony on August 25, 2005 .

EVANS was arrested by Officers of the Colonie Police Department on June 7, 2005 after he had been pulled over for a failure to keep right. When Officers approached the car, they noticed a strong odor of alcohol and they observed EVANS to have slurred speech and glassy eyes. After EVANS failed four field sobriety tests they placed him under arrest.

This was EVANS’ 5 th alcohol related conviction and his first prison sentence. DA Soares noted that the worst recidivists in the County are the drunk drivers and that this is a population that will be spending more and more time in state prison. “Given the clear and present danger posed by drunk drivers, especially those who are multiple recidivists, state prison is the only way I can make the punishment fit the crime,” said Soares.
