Office of the District Attorney P. David Soares David Jorge Sentenced to Max in DV Court ’s First Trial ALBANY , NY – District Attorney P. David Soares announced that DAVID JORGE, of Pearl Street , Albany , NY was sentenced to one year in Albany County Jail after a trial in front of the Honorable William A. Carter presiding over the new Domestic Violence Court . He also faces Post Release Supervision. JORGE had been convicted of Assault in the 3 rd Degree after a jury trial ending in July 29. 2005. The jury found that JORGE was guilty of punching his victim in the face. This case was the first trial to occur in the new Domestic Violence Court . DA Soares pointed out that this case exemplifies the new emphasis that his Office is placing on Domestic Violence cases. “In all likelihood, a case such as this would have been dismissed in the past as soon as the victim expressed a reluctance to participate in the prosecution. Such outcomes which freed perpetrators to subject their victims to additional violence are unacceptable. This court and the special support that it provides to victims of domestic violence is a vital part of an overall emphasis that I am placing on the [prosecution /stamping out] of Domestic Violence here in Albany County ,” he said. “As a prosecutor, my responsibility is to see that DV cases are successfully prosecuted and that perpetrator face justice. To achieve this goal, I have increased staffing in the Special Victims Unit; I have launched a program to instruct law enforcement in the need for the gathering of forensic evidence in DV crime scenes, and I have supported the relocation of the Crime Victims Advocates into my office so victim support can be an integral part of all prosecutions. “This case illustrates the results of this effort. Here my staff worked intensively with the victim to provide the support needed to have the courage to stand up for herself.
