Office of the District Attorney P. David Soares Pauil Gebert Pleads to DWI ALBANY , NY – District Attorney P. David Soares announced today that PAUL GEBERT, 50, of 114 King Road , Schuylerville , NY has pled guilty one count of Driving While Intoxicated as a Felony before the Honorable Thomas A. Breslin. He faces a term of 1 -3 years in State Prison plus a $2500 fine. Sentencing is scheduled for December 19, 2005 . GEBERT was arrested on July 20. 2005 at approximately 9:41 PM on Ontario Street in Cohoes by Officers of the Cohoes Police Department. Officers had observed that the a front seat passenger was not wearing a seat belt and they put on their emergency lights to have GEBERT pull over. Instead GEBERT continued on for several blocks. When he did stop, Officers approached the car and observed a strong odor of alcohol as well as glassy eyes, slurred speech and poor motor coordination. GEBERT refused to participate in a field sobriety test. He also refused three requests to take the alco-sensor and chemical tests to determine blood alcohol level. This is GEBERT’s 6 th alcohol related conviction but only the first time that he has faced State Prison. “The worst recidivists are the drunk drivers.” said DA Soares. “The only way to protect the public from these deadly repeat offenders is to send them off to prison.
