Albany Man Gets 10 Years for Pointing Gun at Cop

ALBANY, NY - District Attorney P. David Soares today announced that QOYA JONES, 20, of Albany, NY, was sentenced to 10 years in prison and 5 years post release supervision by the Honorable Thomas Breslin.

On May 21, 2008 at 9:38 A.M., JONES and CLINKSCALES attempted to enter a home and steal property and money from the residents. Officers responded to the scene and JONES pointed a loaded .40 caliber semi-automatic handgun at the officers. JONES and the CLINKSCALES were taken into custody and the gun recovered.

“Our men and women in uniform leave their families and the comfort of their homes to keep us all safe. That uniform is to be respected,” commented DA Soares. “If you point a loaded weapon at a police officer you are going to prison. Mr. Jones and Mr. Clinkscales are fortunate that those well trained officers did not engage them with lethal force.”

In September, JONES pled guilty to (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Felony.

DANIEL CLINKSCALES, 21, of Albany, NY, was found guilty after jury trial of (2) counts of Attempted Burglary in the First Degree, a Class “C” Violent Felony and (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Violent Felony in front of the Honorable Thomas Breslin. CLINKSCALES faces up to 15 years in prison when sentenced on November 25, 2008.

Street Crimes Bureau Chief Francisco Calderon handled the prosecution of the case.
