Asker Massey Gets 12 Years

ALBANY, NY –  District Attorney P. David Soares announced that ASKER L. MASSEY, 21 of 173 Central Avenue, Albany, NY was sentenced today to a term of 12 years by the Honorable Joseph C. Teresi.

MASSEY had been convicted of Burglary in the 1 st Degree and Assault in the 3 rd Degree after a trial before ending September 21, 2005. The jury found that on or about the 24 th day of March, 2005 at approximately 12:28 AM, MASSEY kicked open the front door of the apartment where his victim was staying. He then proceeded to kick her in the back and head causing substantial pain and swelling. He then took her winter coat and various personal items and fled.

MASSEY was subsequently arrested by Officers Martinez and Sergeant Roberts of the Albany Police Department at the City Market on Clinton Avenue. At the time of his arrest, MASSEY was in possession of the coat along with other personal items taken from the victim.

DA Soares praised the victim and witnesses for their help in the prosecution of this case. “It is very difficult for victims who are exposed to the pressure of the perpetrator’s family to have the courage to come forward and support the prosecution. In this case we did have the victim’s full support and that was crucial to the successful prosecution of the case. This case would also not have been possible without the work of the Crime Victims Advocates. This sentence simply underscores the critical role that Victims Services plays in law enforcement,” he said.

Further evidence of the pressures that the defendant’s family placed on the victim were displayed during today’s sentencing. When the sentence was read in court, the victim’s mother, who weighs in excess of 390 pounds, let out a wail and then proceeded to assault the victim until court officers intervened. The mother is currently being booked in Police Court for assault.
