Michael Delvalle Indicted

17 Ounces of Cocaine Seized

ALBANY, NY – District Attorney P. David Soares today announced that MAICHAEL A. DELVALLE, 39, of 160 Eliott Avenue, Yonkers, NY was indicted on two counts including Criminal Possession of a Controlled Substance in the 1 st Degree and Criminal Possession of a Controlled Substance in the 3 rd Degree.

The indictment alleges that on or about the 5 th day of October, 2005, DELVALLE had in his possession over 17 ounces of cocaine and that he intended to sell it. DELVALLE was arrested by NYS Troopers after he was clocked speeding at 85 MPH on the NYS Thruway. As Officers were pulling over the car, they noticed the defendant making a stuffing motion in the pocket behind the front seat of the car. Then when they approached the car, they noticed a taser on the car floor on the driver’s side. They then asked DELVALELLE to exit the car. Upon further investigation the Officers found two plastic bags, each containing over 8 ounces of cocaine in the pocket behind the front seat. DELVALLE subsequently gave a statement in which he admitted his possession fo the narcotic.

DA Soares was pleased with the quantity of drugs seized in this arrest. “Seventeen ounces has a street value of over $50,000. But it is clear that this bust just illustrates the enormity of the challenge that faces us,” he said. “We have to acknowledge that Albany County is a major thoroughfare for the trafficking of narcotics to destinations including the Capital District, upstate cities such as Rochester, Syracuse and Buffalo and even Canada. Fighting a broad criminal enterprise such as this will require broad inter-agency cooperation,” he added.

If convicted on both counts, DELVALLE faces up to 20 years in jail.

Arraignment is scheduled for Friday, November 4, 2005.
