Office of the District Attorney P. David Soares Joseph E Hyson Jr. Pleads Guilty to Felony DWI ALBANY, NY – District Attorney P. David Soares today announced that JOSEPH E. HYSON, Jr. 39, of 9779 State Route 81, Greenville, NY pled guilty to one count of Driving While Intoxicated as an E Felony before the Honorable Thomas A. Breslin. He faces a term of no less than 6 months in county jail plus five years probation and no more than 1 to 3 years in state prison. Sentencing is scheduled to take place January 4, 2006. HYSON was arrested on April 5, 2005 at approximately 6:49 PM after officers of the Albany County Sheriff’s Department observed the defendant traveling northbound on State Route 32 in the Town of Westerlo at a speed in excess of 75 MPH in a 55 MPH zone. The Deputy activated his lights and sirens but HYSON continued on for approximately another 9 miles passing cars and repeatedly crossing the double yellow lines. At times, during the pursuit, HYSON reached speeds of approximately 100 MPH. Eventually, HYSON got caught behind a truck and the Deputy caught up to him. HYSON failed three field sobriety tests. At the time of his arrest, HYSON was found to be in possession of a switchblade knife. This is HYSON’s 12 th arrest dating back to 1982. It is his 5 th alcohol related driving arrest. “We intend to argue before Judge Breslin that HYSON be sent to prison for the maximum term of 1 to 3 years.
