Albany Man Gets 9 Years After Fingerprint Found at Scene ALBANY , NY - District Attorney P. David Soares today announced that ROBERT DEMPSEY, 42, of Orange Street, Albany, NY, was sentenced to 9 years in prison and 5 years post release supervision as a second felony offender by the Honorable Dan Lamont. In April, DEMPSEY pled guilty to (1) count of Burglary in the Second Degree, a Class “ C ” Violent Felony. DEMPSEY was previously convicted of the crime Attempted Burglary in the Third Degree in March 2002. “Unfortunately as the weather gets warmer, the threat of criminals taking advantage of unlocked screen doors and windows increases. I am pleased that this man will no longer be a threat to our community, but I urge everyone to be vigilant and keep doors and windows locked while they are at home and away,” commented DA Soares. Between July 30, 2007 and July 31, 2007, DEMPSEY entered a residence at 225 Western Avenue through a window. While inside, DEMPSEY stole a rifle and a shotgun along with various other items. Later that evening, Albany Police received a call about a man walking down the street with some guns. Upon responding, Officers recovered the guns and other items from DEMPSEY. The owners identified the weapons and DEMPSEY had no permission to be in the residence. As part of the investigation, Albany Police were able to lift fingerprints from the window. The prints were sent to DCJS where a match was identified, that match being DEMPSEY. Street Crimes Bureau Chief Francisco Calderon handled the prosecution of the case.
