Corrections Officer Pleads Not Guilty to Fraud

ALBANY , NY – District Attorney P. David Soares today announced the arraignment of NILDA DARDIZ, 45, of Renssealer, NY, on five counts including: Insurance Fraud in the 3rd Degree, Grand Larceny in the 3rd Degree, Offering a False Instrument for Filing in the 1st Degree, Perjury in the 1st Degree and Presenting a Violation of the Worker’s Compensation Law. DARDIZ pled not guilty and was released.

The indictment alleges that between October 1, 2005 and August 2, 2006, DARDIZ wrongfully obtained disability from the New York State Workers Compensation Board by stating that she was not working during this time, when she was employed at the Target Corporation and receiving a weekly paycheck. DARDIZ did not report this income to the New York State Worker’s Compensation Board and did not claim the income on a Worker’s Compensation Questionnaire. Additionally, DARDIZ did swear under oath at a Worker’s Compensation hearing that she had not worked since January 23, 2004 when in fact she had been employed by the Target Corporation from October 2005 until August 2006.

“As a member of the law enforcement community, Ms. Dardiz is very aware of the law and the punishments for violating laws,” commented DA Soares. “Ms. Dardiz will continue to be treated in the same manner as any citizen accused of this crime.”

ADA Chris Baynes from the Financial Crimes Unit is handling the prosecution of this case.

DARDIZ is due back in court on May 31, 2007.
