Office of the District Attorney Third Doctor in ‘Operation Which Doctor’ Case Pleads Guilty, Agrees to Cooperate Against Remaining Defendants ALBANY , NY – Albany County District Attorney P. David Soares announced today that GARY BRANDWEIN, 52, of Florida, pled guilty to Criminal Sale of a Controlled Substance in the Fifth Degree, a Class “D” Felony , in front of the Honorable Stephen Herrick. BRANDWEIN faces a maximum of one year in state prison. But under the terms of the plea bargain, BRANDWEIN faces up to 2½ years in prison if he fails to cooperate in the case against Signature Pharmacy. On or about the May 25, 2006, at Century Hill Drive, Village of Latham, in the Town of Colonie, BRANDWEIN did knowingly sell to another person a controlled substance Nandralone. “I am very pleased to see yet another doctor take responsibility for violating their oath and illegally dispensing drugs into our community. With this guilty plea, there are now ten people who have agreed to cooperate with our investigation into the inner workings of Signature Pharmacy,” commented DA Soares.
