Office of the District Attorney P. David Soares Albany Police Sergeant Arraigned for Pointing Gun at Clerk ALBANY , NY – District Attorney P. David Soares today announced that KEVIN MCKENNA, 43, of Albany , NY was arraigned on a sealed indictment consisting of (1) count of Menacing in the Second Degree, a Class “A” Misdemeanor, by the Honorable Stephen W. Herrick. MCKENNA pled not guilty. “Mr. McKenna, like every citizen of Albany County, will be held to one standard of justice. As it stands, this indictment is an allegation. We have the burden of proof and we will fulfill that obligation on behalf of the victim. No citizen should be forced to endure any type of harassment in the workplace, and that type of illegal behavior will not be tolerated in Albany County.” The indictment alleges on January 2, 2008, at approximately 10:30 P.M., in the Albany Police Department Traffic Safety Division located at 526 Central Avenue in the City of Albany, KEVIN McKENNA did intentionally place or attempt to place another person in reasonable fear of physical injury, serious physical injury or death by means of pointing a loaded firearm, a Glock .45 caliber pistol, at the victim from a close distance away.
