DA Announces Sentencing of PETER SPINELLI,
Three to Nine Years in Prison

ALBANY , NY – Albany County District Attorney P. David Soares announced today the sentencing of PETER SPINELLI, 50, of Krumkill Road, Guilderland, NY. SPINELLI was sentenced this morning before the Honorable Thomas Breslin after pleading guilty to (2) counts of Grand Larceny in the Third Degree. SPINELLI will spend three to nine years in prison and pay full restitution to his victims, $391,117.56, after the sale of his home is completed.

PETER SPINELLI plead guilty to stealing property from customers of Spinelli Jewelers located at 1315 Central Avenue in the Town of Colonie. On several different occasions SPINELLI sold jewelry to customers that was purported to contain real diamonds when in fact they contained fake stones. In one instance, the defendant is alleged to have replaced a 73 year old family stone with moissanite when it was entrusted to him for resetting.

In addition, during the taxable years of January 1, 1999 – December 31, 2001, SPINELLI evaded tax payments and failed to file his personal income tax returns with the State of New York for three consecutive years.

District Attorney Soares stated today, “On behalf of all the victims who have been cheated by Mr. Spinelli, we are pleased with the final outcome of this case. Mr. Spinelli criminally violated the trust of his clients and we hope that through restitution to his victims and a significant prison term, we have helped to restore public confidence in an honorable profession and deter anyone who may be thinking of committing similar crimes.”
