Professional Shoplifter Receives Stiff Sentence ALBANY, NY – Albany County District Attorney P. David Soares announced today that HERBERT GOLDER, 59, of 47 Summit Drive, Cranston, RI has been sentenced to up to seven years in state prison by the Honorable Stephen W. Herrick. GOLDER plead guilty to Criminal Possession of Stolen Property in the Third Degree. On March 1, 2006, GOLDER attempted to leave the FYE store in Colonie Center mall. He was carrying a large plastic bag which was lined with foil and taped over with duct tape and which held just under $1,000 worth of stolen DVDs. The manager tried to stop GOLDER, who hit the manager in the head with the bag and then a struggle ensued wherein blows were exchanged. GOLDER was subdued and held down by the manager with the help of a very large intervening citizen (6’10’’, 320 lbs) and an off-duty state trooper who handcuffed GOLDER using cuffs from a mall security officer. Police discovered the defendant was driving a rental car which was located and searched pursuant to a search warrant. The trunk of the car contained approximately $10,000 worth of DVDs and CDs identified as stolen from various stores throughout New England. GOLDER appeared in court for a routine sentencing on March 21, 2007 where it was expected he would receive a sentence of two to four years as agreed to in a plea bargain. At that time, the sentencing was postponed to May 2, 2007 and GOLDER was released on the existing $35,000 bail with the provision he did not violate the conditions of the plea. Later that evening, GOLDER was arrested in Tompkins County, NY, with over $3,000 worth of stolen DVDs and CDs in the trunk of his car. Judge Herrick then issued a bench warrant for GOLDER who was sentenced yesterday evening to the maximum sentence for the charge in Albany County, three and a half to seven years. The charges in Tompkins County remain pending. Upon learning the circumstances surrounding the sentencing, District Attorney Soares commented, “Mr. Golder was offered a plea by this office and chose to blatantly ignore the requirements of that agreement. Due to his actions and severe disregard for the law and legal system, he will serve the maximum sentence allowed for under the law.” ADA Bruce Lennard from the Major Offense Unit handled the prosecution of this case.
