Dolan Convicted of Attempted Kidnapping and Assault

Faces 15 Years

ALBANY , NY –  District Attorney P. David Soares today announced that JOHN DOLAN, 46, of Country Acre Lane , Saratoga , NY was convicted after trial before the Honorable Dan Lamont of Attempted Kidnapping in the 2 nd Degree and Assault in the 2 nd Degree.

He faces a term of 15 years. Sentencing is scheduled for April, 21, 2006 .

In reaching their guilty verdict, the jury found that on or about 27 th of June, 2005 at approximately 2:25 PM at 35 Hackett Boulevard , DOLAN approached his former girlfriend of 17 years, displayed a 357 Colt revolver, and demanded that she move over into the passenger side of her vehicle, threatening to kill her. When she refused, DOLAN began to beat her and tried to lift her into the passenger seat. In the ensuing struggle, the victim managed to kick the gun from DOLAN’s hand and exit the vehicle, pushing the gun beneath the car. DOLAN once again attempted to force her into her car, before fleeing the scene as bystanders approached.

Later that afternoon, DOLAN was stopped by a State Trooper who noticed that DOLAN was driving without a seatbelt. When the Trooper pulled him over, he saw that DOLAN had a knife sticking from his chest. A subsequent search revealed a suicide note addressed to DOLAN’s children assigning them money, instructing them to get his dogs back from the victim’s sister, and apologizing for his actions. DOLAN was then taken under Police Escort to Albany Med where he remained unconscious for almost two days. When DOLAN regained consciousness he was arrested.

The verdict was the 2 nd guilty verdict for prosecutor David Gonzalez in 2 weeks. It was also the 2 nd guilty verdict for the DA’s Office on Friday since Brian Farley obtained a guilty verdict in the retrial of JAMES NAHEEN BILLUPS.

DA Soares noted that the effective prosecution of this case was supported by the active role of the Crime Victim Advocates who provided reassurance to the victim throughout the prosecution and the trial. “Crime victim advocates are an essential tool to law enforcement and effective prosecution,” Soares said. “In cases of assault, kidnapping, sexual abuse, or rape, the victim is the primary witness. Providing these victims with the services, sympathy and emotional support they so desperately need is a fundamental mission of this Office,” Soares added.
