Office of the District Attorney P. David Soares Guilty Verdict for Steven Dorney ALBANY, NY – District Attorney P. David Soares today announced the verdict in the trial of STEVEN DORNEY51, of 229 Livingston Avenue, Albany, NY. DORNEY was found guilty on one count of criminal possession of marijuana in the first degree, after a trial before the Honorable Joseph C. Teresi. The case resulted from some smart police work by Officer Robert Shunk of the Albany Police Department. On the morning of September 17 th, 2004, Officer Shunk noticed a woman entering the rear door of what appeared to be an abandoned building located at 101 Elizabeth Street in the City of Albany. The Officer approached the woman and was directed to the front door. Upon arriving at the front door, Officer Shunk saw both the woman and the defendant. Speaking to both of them individually, he received conflicting stories as to why they were at that location. After consulting with supervisors and getting backup, and believing that these two individuals had no right to be in the building, Shunk entered the building through a ground floor window. When he did so, he smelled the strong and distinctive odor of marijuana and noticed a variety of packaging materials. He withdrew while the APD applied for and received a search warrant. Within the hour, the warrant was served and the building was raided. In the building, Officers found seventeen pounds of marijuana with a street value estimated to be $42,500, $19,000 in cash and, in the bedroom, they found the defendant’s passport and a logbook containing evidence of a great many marijuana sales along with other personal papers, and a passport belonging to the defendant. DORNEY faces 7 1/2 to 15 years in state prison. Having been deported once before and having returned illegally under a false name, the defendant faces deportation again upon the conclusion of his sentence. Soares praised the work of his staff, especially ADA Eric Galarneau on securing the guilty verdict and the Police Department for their excellent work.
