Albany Man Received 6 Years After DNA Recovered on Gun– District Attorney P. David Soares today announced that EIRSHAWN DONLEY, 30, of 162 Ida Yarborough, Albany, NY was sentenced to 3 to 6 years in prison by the Honorable Stephen Herrick. In April, DONLEY was found guilty after a jury trial of (1) count of Criminal Possession of a Weapon in the Third Degree, a Class “D” Felony.

Albany Man Pleads Guilty After Parole Officer Finds Drugs in Home– District Attorney P. David Soares today announced that JOSEPH KIRNON, 33, of Albany, NY, pled guilty to Criminal Possession of a Controlled Substance in the Fourth Degree, a Class “C” Felony in front of the Honorable Stephen Herrick. In accordance with the plea bargain, KIRNON faces 6 years in prison and 3 years post release supervision when sentenced in July.

Bethlehem Man Found Guilty of Raping Two Teens– District Attorney P. David Soares today announced that RICHARD CLEVENSTINE, 59, of Bethlehem, NY, was found guilty after a jury trial of  11 counts including; (2) counts of Rape in the Second Degree, a Class “D” Felony, (3) counts of Rape in the Third Degree, a Class “E” Felony, (1) count of Criminal Sexual Act in the Third Degree, a Class “E” Felony, (3) counts of Endangering the Welfare of a Child, a Class “A” Misdemeanor, (1) count of Attempted Criminal Sexual Act in the Third Degree, a Class “A” Misdemeanor, and (1) count of Sexual Abuse in the Third Degree, a Class “B” Misdemeanor  in front of the Honorable Thomas Breslin. CLEVENSTINE faces a maximum of 26 years in prison when sentenced in July.

Chinese Food Robber Sentenced to 12 Years After Being Apprehended by Restaurant Owner – District Attorney P. David Soares today announced that RICHARD SMITH, 42, of Albany, NY, was sentenced to 12 years in prison by the Honorable Thomas Breslin. In April, SMITH pled guilty to (1) count of Robbery in the Second Degree, a Class “C” Felony.

15 Year Old Indicted For Murder of Kathina Thomas – District Attorney P. David Soares today announced that JERMAYNE TIMMONS, A.K.A. “MAINE”, 15, of Albany, NY, was indicted by the Grand Jury on five counts including; (2) counts of Murder in the Second Degree, a Class “A-1” Felony, (1) count of Manslaughter in the First Degree, a Class “B” Felony, (1) count of Manslaughter in the Second Degree, a Class “C” Felony and (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Violent Felony. TIMMONS faces 15 years to life in prison.

15 Year Old Arraigned for Murder of Kathina Thomas – District Attorney P. David Soares today announced that JERMAYNE TIMMONS, A.K.A. “MAINE”, 15, of Albany, NY, was arraigned on five counts including; (2) counts of Murder in the Second Degree, a Class “A-1” Felony, (1) count of Manslaughter in the First Degree, a Class “B” Felony, (1) count of Manslaughter in the Second Degree, a Class “C” Felony and (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Violent Felony, in front of the Honorable Stephen Herrick. TIMMONS pled not guilty and was remanded into the custody of the Albany County Sheriff. TIMMONS faces 15 years to life in prison.

Aaron Dare and Girlfriend Face 25 Years for Real Estate Scams Totaling more than $1.6 Million –  Albany County District Attorney P. David Soares announced today that AARON DARE of Albany, NY, and ANA PAULA MONTEIRO of Albany, NY, were arraigned on a sealed indictment consisting 59 counts including: (1) count of Money Laundering in the First Degree, a Class “B” Felony, (22) counts of Grand Larceny in the Second Degree, a Class “C” Felony, (4) counts of Attempted Grand Larceny in the Second Degree, a Class “D” Felony, (2) counts of Grand Larceny in the Third Degree, a Class “D” Felony, (5) counts of Criminal Possession of a Forged Instrument in the Second Degree, a Class “D” Felony and (1) count of Forgery in the Second Degree, a Class “D” Felony and (19) counts of Falsifying Business Records in the First Degree, a Class “E” Felony in front of the Honorable Thomas Breslin. MONTEIRO faces an additional 5 counts including: (1) count of Scheme to Defraud in the First Degree, a Class “E” Felony, (2) counts of Filing a False and Fraudulent Personal Income Tax Return, a Class “E” Felony and (2) counts of Failure to File a Personal Income Tax Return, an unclassified misdemeanor.
