Chinese Food Robber Sentenced to 12 Years After Being Apprehended by Restaurant Owner

ALBANY , NY – District Attorney P. David Soares today announced that RICHARD SMITH, 42, of Albany, NY, was sentenced to 12 years in prison by the Honorable Thomas Breslin. In April, SMITH pled guilty to (1) count of Robbery in the Second Degree, a Class “C” Felony.

On December 1, 2007 at approximately 9:37 P.M. at the Amazing Wok Restaurant located at 267 Lark Street in the City of Albany, SMITH robbed a cashier by pointing a 12-inch kitchen knife at her and stealing cash. Before SMITH was able to get away, the restaurant owner chased him around the corner, personally apprehended him and held him until police arrived.

“While I do not advocate taking the law into your own hands, this brave victim took a stand to ensure that this criminal would not get away, but would instead be held accountable for his crime. As a result of the heroic actions taken by the restaurant owner that evening, this individual will be off the streets for the next twelve years and will no longer be a threat to our community,” commented DA Soares.

Assistant District Attorney Erin Reese handled the prosecution of this case.
