Public Integrity Unit Indicts Under Identity Theft Law

ALBANY, NY –  District Attorney P. David Soares today announced that the Office’s Public Integrity Unit had secured its first indictment under the State’s new Identity Theft Statute. ELIZABETH ANN BURBAGE, 22 of 33 South Manning Boulevard, Albany, NY was indicted on one count of Identity Theft in the First Degree and Grand Larceny in the Fourth Degree.

The indictments allege that between November 20, 2004 and December 16, 2004, BURBAGE stole a set of credit cards and, by presenting herself as the owner of the credit cards, did steal more than two thousand dollars worth of goods or services or cash advances.

According to DA Soares, the penalties under the Identity Theft statute are an important tool for fighting this rapidly growing type of crime. “People need to realize that assuming someone’s identity to defraud them can cause even greater damage than even the stealing of cash because it can result in ruined credit ratings,” he said. “We need to get the word out that if you steal someone’s credit card and then use it, you’re going to go to prison,” he added.

If convicted on both counts, BURBAGE faces 2 1/3 rd to 7 years in state prison.
