Darnell Ellis Gets 11 ½ to 16

ALBANY, NY –  District Attorney P. David Soares today announced that DARNELL ELLIS, 30, of Livingston Avenue, Albany, NY was sentenced to 11 ½ to 16 years by the Honorable Dan Lamont. The sentence includes 4 ½ to 9 for a guilty verdict for the Criminal Sale of a Controlled Substance in the Third Degree after a trial before the Honorable Dan Lamont and 7 years for a guilty plea to one count of Assault in the Second Degree.

ELLIS’s partner in the Assault case was his brother BILLY. BILLY ELLIS, 32, also of Livingston Avenue in Albany, New York was convicted of ASSAULT in the Second Degree after a trial before the Honorable Stephen W. Herrick in early April, 2005. BILLY ELLIS received a sentence of seven years for his conviction.

In the criminal sale trial, DARNELL ELLIS was convicted to having sold crack. The sale was captured on audio tape by a police surveillance team.

In the Assault case, ELLIS along with his brother BILLY were driving along on Livingston Avenue last June 27 at 1:00 PM when they spotted their victim. They stopped their car and brutally beat the victim resulting in a punctured lung, multiple rib fractures, and a lacerated kidney requiring life saving emergency care and a ten day hospital stay.

DA Soares applauded the work of Street Crimes Bureau ADA Tiffany Rutnik who handled all three indictments. “These sentences represent a significant amount of time. For all intents and purposes, a gang of two has been removed from the streets of Albany,” he said.
