Woman Receives 4 Years for Assaulting Police Officer ALBANY , NY – District Attorney P. David Soares today announced that DANIELLE NISSELBACK, 26, of Cohoes, NY, was sentenced to 4 years in state prison by the Honorable Thomas Breslin. In May, NISSELBACK was found guilty after a jury trial of (1) count of Assault in the Second Degree, a Class “D” Violent Felony. “I would like to commend and sincerely thank Albany Police Officers Gregory Mulligan, William Norris, Thomas Mahar, Milton Johnson, Zee Kitoni, James Kittleman, William Pierce, Anthony Deso, Noral Riviello and Luther Dorsey for the professionalism displayed during the arrest and trial of this difficult and complex case,” commented District Attorney Soares. “While it is unfortunate that a night of heavy drinking turned into a four year prison sentence because Ms. Nisselback could not control her behavior, I hope the guilty verdict and sentence imposed today sends a crystal clear message that violence of any kind committed against members of law enforcement will not be tolerated. I will continue to aggressively prosecute individuals who place our officers in danger. In this case, the officers were not only victims of a physical attack but their reputations were maligned, and that is unacceptable. I want to thank Assistant District Attorney Brian Conley and the jury for ensuring that these officers received same Justice they assist in dispensing on behalf of the citizens of Albany County everyday when they report for duty.” On February 1, 2009 at approximately 3:10 A.M. in the vicinity of 304 Lark Street, DANIELLE NISSELBACK was involved in a fight with several other individuals. During the altercation, Albany Police Officer Gregory Mulligan approached NISSELBACK, who was being restrained by a bouncer, to put her in handcuffs. NISSELBACK then kicked Officer Mulligan in the groin area, causing contusions, substantial pain and serious physical impairment.
