Albany Men Plead Guilty to Robbery at Cocca’s Motel

ALBANY, NY – District Attorney P. David Soares today announced that JOSHUA E MCCUNE, 24, and CHEVIS M TERRY JR, 23, both of Albany, NY, pled guilty to (1) count of Robbery in the Third Degree, a Class “D” Felony before the Honorable Thomas A. Breslin.

On July 9, 2009, at approximately 10:55 P.M., at Cocca’s Inns and Suites located on Wolf Road in the Town of Colonie, MCCUNE and TERRY forcibly stole a wallet and a quantity of U.S. Currency from a male victim by displaying a handgun. Earlier in the evening, the victim was in the room with a woman and had given her a one hundred dollar bill for her to get change. MCCUNE and TERRY were acquaintances of the woman and, after realizing the victim had money, accompanied her back to the motel room, and robbed the victim of several hundred dollars. After being provided with a description of the getaway vehicle, police apprehended MCCUNE and TERRY. A search warrant was executed and officers recovered the victim’s wallet, cash and a .25 caliber semi-automatic handgun. The handgun was not loaded and no magazine was found.

Under the terms of the plea bargain, both MCCUNE and TERRY will receive 2 to 6 years in state prison. MCCUNE is scheduled to be sentenced on September 11, 2009 and TERRY is scheduled to be sentenced on September 15, 2009.

Major Offense Bureau Chief Bruce Lennard handled the prosecution of this case.
