Loudonville Man Pleads Guilty to Aggravated Vehicular Assault and DWI after Fleeing to Florida
Brodeur is the First to be Convicted of New Law in Albany County

ALBANY , NY –  District Attorney P. David Soares today announced that DENNIS BRODEUR, 47, of Loudonville, NY, pled guilty to (1) count of Aggravated Vehicular Assault, a Class “C” Felony and (1) count of misdemeanor DWI in front of the Honorable Dan Lamont.

This is the first time that an individual has been indicted and convicted of the charge of Aggravated Vehicular Assault in Albany County since the law was enacted in November of 2007.

On February 2, 2008 at approximately 6:05 P.M. on Route 9, Loudonville Road in the City of Albany, DENNIS BRODEUR operated a motor vehicle in a reckless manner, while having a BAC of more than .18. The vehicle BRODUER was driving crossed over into the on-coming lane of traffic and collided with a vehicle operated by a 24 year-old female. The collision caused serious physical injury to the victim consisting of bilateral femur fractures, multiple fractures to the left humerus, radius with ulna and Monteggia fracture, along with other injuries, causing substantial pain and requiring immediate medical treatment, surgery and on-going treatment, which continues even today.

Additionally, BRODEUR failed to appear in court for a scheduled court date at the end of May and was subsequently found by the U.S. Marshalls in Florida. In accordance with the plea bargain, BRODEUR faces 3 1/3 to 10 years in prison when sentenced on September 5, 2008. BRODUER was remanded into the custody of the Albany County Sheriff.

“DWI crimes are not merely ‘accidents’, they are among the most avoidable crimes and those who choose to drink and drive will continue to face severe penalties in Albany County,” commented DA Soares. “I have been truly amazed by the strength of the victim in this case and it is my hope that the plea today will help bring about the healing process and closure necessary for this inspirational young woman to continue with her life. And as we celebrate the upcoming July 4 th weekend, I hope that this case serves as a reminder to us all that the easy decision to not drink and drive can, and will prevent tragedies like these from occurring.”
