Office of the District Attorney P. David Soares ALBANY, NY – District Attorney P. David Soares the sentencing in People v. Elnor Thomas, Thursday, July 6, 2006. ELNOR THOMAS, 33, of 441 Elk Street, Albany, NY was sentenced to (1) count of Assault in the Second Degree, a class “D” Felony. THOMAS was sentenced to 6 years in state prison and 3 years post release in front of the Hon. Stephen Herrick. ELNOR THOMAS has admitted that on or between the approximate dates of March 18 and April 16, 2006, THOMAS did, with intent, cause physical injury to the victim who was less than 7 years old. The child’s injuries included a fracture to the arm, retinal hemorrhaging, bruises, abrasions, and lacerations to the neck, head, and back. The child was left unfed and malnourished causing her to eat her own hair and to be in the 63% of the height and weight for the child’s age. Soares stated, “Having ELNOR THOMAS away from her children is the ultimate closure of this case. It should be noted that children in the County of Albany are being battered, neglected, and even, in this case-- left unfed by adults with whom they should trust the most in their world. We will continue to prosecute individuals like THOMAS and hold them accountable for these horrific acts.” Soares pointed out the crucial role of law enforcement in collecting evidence as a key to bringing defendants to justice. "We have to invest in prevention to protect these children, and give them the opportunity to grow up healthy-- it is time to act and re-establish the Child Advocacy Center.” The Special Victim’s Unit within the District Attorney’s Office was established last year, in part of the reorganization within the Albany County District Attorney’s Office.
