David Soares Stephen Barrera Indicted on 4 Counts Including 2 Counts of DWI, Evidence Tampering and Obstructing Governmental Administration ALBANY, NY – District Attorney P. David Soares today announced that STEPHEN BARRERA, 41, of 7 Deerpath Drive, Schenectady, NY was indicted on four counts including two felony counts of Operating a Vehicle While Under the Influence of Alcohol, Tampering with Physical Evidence – all felony charges, and Obstructing Governmental Administration in the 2 nd Degree, a Misdemeanor. The indictments allege that at approximately 12:40 AM on or about July 15 th, 2005, BARRERA was operating a green 1998 Plymouth on Route 20 in the Town of Guilderland. Officers from the Guilderland Police Department pulled him over for failure to keep right and found him in a severely intoxicated condition with an open container of alcohol in the vehicle. BARRERA was taken to the Guilderland Police Station where he underwent a chemical test to determine his blood alcohol content. BARRERA was found to be well over the legal limit. BARRERA is then accused of tearing up and destroying a series of documents including a DWI Supporting Deposition, a Bill of Particulars, the Datamaster printout and check list and the officer’ s notes. Finally, BARRERA is alleged to have obstructed the operations of the Guilderland Police by advising another DWI suspect to refuse to undergo a chemical test of his blood. If convicted on all counts BARRERA faces 2 1/3 - 7 years state prison. The arraignment is scheduled for Friday, July 29, 2005 before the Honorable Thomas A. Breslin.
