Office of the District Attorney P. David Soares Michael Elston Sentencing ALBANY, NY – District Attorney P. David Soares today announced that Michael Elston, 16, of 130 Spring Street, Buffalo, NY, was sentenced today on charges of Rape in the First Degree and Kidnapping in the Second Degree before the Honorable Stephen W. Herrick. ELSTON will serve 20 years on the Rape charge and 7 years on the Kidnapping charge. The terms will run consecutively meaning that Elston will serve 27 just one year shy of the legal maximum of 28 years. He will then face ten years of Post Release Supervision. He will also be required to register as a sex offender and was given a 25 court order of protection prohibiting him from making any contact with the victim of his attack. DA Soares said he was pleased with the sentence. “This young man will be in prison until he is 43 years old,” the DA said. “But no sentence can ever heal the wounds or repair the damage of this brutal and vicious attack. Today you saw a well-spoken polite man in court but last December this young man set out on a self destructive course. On December 28 th this ticking time bomb exploded and he took with him a woman, a family and a community. Now he will have 27 years to contemplate the damage that he has caused. I can only hope that this sentence, one year short of the maximum allowable by law, will provide some solace to the victim and her family,” Soares added. On May 27, 2005, ELSTON, a resident of 27 Camp Cass Road, in the Town of Rensselaerville, NY, plead guilty to raping a female victim after displaying a kitchen knife and threatening to slit her throat.
