Home Invasion and Cell Phone Theft Result in Sentences adding up to 53 Years

ALBANY , NY –  District Attorney P. David Soares announced today that OMAR R PERKINS

26, of 39 North Manning Boulevard , Albany NY was sentenced today for 28 years on a home invasion and burglary. PERKINS’ partner, RORY PINTO, 19, of 152 McCarthy Street , Albany , NY was sentenced on January 11, 2006 to 25 years. Both defendants were sentenced by the Honorable Stephen W. Herrick.

PERKINS and PINTO were arrested on March 20, 2005 by Officers of the Albany Police Department minutes after he had participated in an invasion and robbery of a Lark Drive home in which they broke into the dwelling, threatened the occupants with a weapon, tied them up, demanded money, and then stole a cell phone. The arresting Officers captured the pair after a foot pursuit.

The pair were indicted on April 27, 2005 on 8 counts including two counts of Burglary in the 2 nd Degree, two counts of Robbery in the 2 nd Degree, Criminal Use of a Firearm in the 3 rd, two counts of Unlawful Imprisonment in the 1 st Degree, and Resisting Arrest.

PINTO was convicted at trial on the Burglary and Robbery and Firearms Counts. His sentencing on January 11, was for 12 ½ years on each of the two Burglary Counts running concurrently, 12 ½ years on each of the Robbery Counts running concurrently to each other and consecutively to the Burglary sentences, and 12 ½ years on the Firearms Count running concurrently with the other sentences for a total of 25 years with 5 years of post release supervision.

PERKINS was sentenced today to 14 years on each of two counts of Burglary in the 2 nd, sentences to run concurrently, 14 years on each of two counts of Robbery in the 2 nd each to run concurrently but consecutive to the Burglary sentences, 14 years on one count of Criminal Use of a Firearm to run concurrently, and 1 year on the resisting arrest charge, also to run concurrently. The net total is 28 years with 5 years of post release supervision.

DA Soares noted that PINTO and PERKINS stole a cell phone. “Criminals don’t realize the severity of the sentences for robbery and burglary. You might think, ’25 or 28 years for stealing a cell phone, that’s crazy’ but this was a violent crime and these perpetrators deserves every day, week, year and decade that they will be spending in prison. Additionally, society, the legislature, and my Office regard the home as sacred. If you break into someone’s home, rob them and threaten them with a gun, you are violating one of the fundamental principles of a civilized people and my Office will prosecute you to the fullest extent of the law and you will face a very long time in prison,” Soares said.

“Here’s my message: ‘Enough is enough. If you carry a weapon and commit a crime in Albany County, you had better be prepared to spend the best years of your life behind bars,’” Soares added.
