Office of the District Attorney P. David Soares Possesses Gun Faces 7 ALBANY , NY – District Attorney P. David Soares announced that NORMAN THAXTER, 46, of 342 Third Street , Albany , NY was indicted today on one count of Criminal Possession of a Weapon in the 3 rd Degree. THAXTER was arrested on December 2, 2005 after he was spotted in possession of a loaded Smith and Wesson 357 Magnum revolver at 500 Northern Boulevard , Albany , NY by Officers of the Albany Police Department responding to a disturbance complaint. DA Soares noted that there was no evidence that THAXTER intended to use the weapon in the course of a crime nor was there any evidence that THAXTER intended to use the weapon to harm anyone. Nevertheless, THAXTER faces a possible 7 year term. “It is a crime to carry an unregistered weapon outside of your home or place of business. It is a crime that carries a possible seven year sentence. This Office is committed to prosecuting all gun cases aggressively and in this case, this man faces seven years in prison,” Soares said.
