Faces 15 on Weapons Charges

  ALBANY , NY –  District Attorney P. David Soares announced today that MICHAEL SMITH-HAMLIN, 21, of 182 North Allen Street, Albany, NY was indicted on 3 counts including Criminal Possession of a Weapon in the 2 nd Degree and 3 rd Degrees, and Criminal Possession of Marijuana in the 4 th Degree. He will be arraigned Friday, January 20, 2006 . If convicted on all charges, SMITH-HAMLIN faces a possible 15 years in state prison.

The indictment alleges that on or about the 16 th day of December, 2005 at 182 North Allen Street in the City of Albany, NY, as the result of a search authorized by a search warrant, SMITH-HAMLIN was found to be in possession of a loaded Beretta .45 caliber Long Barrel Colt revolver and that he possessed it with the intent to use it unlawfully against another. He was also found to be in possession of more than 2 ounces of marijuana.

District Attorney Soares noted that the troubling aspect of this arrest was what SMITH-HAMLIN was not charged with. “At the time of his arrest, this defendant also possessed a 40 caliber Kel-Tec rifle which he had legally purchased the very day of his arrest. He also owned a bullet-proof vest,” the DA said. “Our legislature has taken significant steps with recent legislation in the effort to curb gun violence. However, we have to address the supply side of this equation. The defendant has a previous conviction for the possession of burglary tools and he was legally able to purchase a weapon. There’s something wrong with this picture,” Soares said.
