Sentencing of Justin Terrell Rescheduled

ALBANY, NY –  District Attorney P. David Soares today announced that the sentencing of Justin Terrell would be rescheduled. TERRELL had agreed to a sentence of 19 years for the beating of his seven week old son. At the time that the Honorable Stephen J. Herrick had approved of the plea agreement, he had placed certain contingencies upon the agreement. One of these contingencies was the commitment on the part of the defendant to cooperate with the Probation Department.

Prior to every sentencing for a felony offence, the Probation Department prepares a pre-sentencing report. In this case, however, TERRELL denied that he had intended to harm the child despite having admitted to having done so under oath during the 11/29/04 hearing. TERRELL is entitled to a hearing with the Probation Officer who interviewed him. Today he requested such an interview. Sentencing has been deferred until a hearing with the Probation Department can be scheduled.
