Office of the District Attorney P. David Soares Sentencing of Kevin Cherry ALBANY, NY – District Attorney P. David Soares today announced that the sentencing of KEVIN CHERRY, 25, of 22 Oakbrook Manor, Ravena, NY is scheduled to take place before the Honorable Thomas A. Breslin tomorrow. CHERRY was convicted after a trail held in December 2004 on ten counts including multiple burglary counts, multiple robbery counts, and three counts of Murder in the First Degree and two counts of Murder in the Second Degree, Class A-1 Felonies. The charges related to two separate incidents. The first was a home invasion on Dana Avenue in the City of Albany which took place on March 8 th 2001. During that event, CHERRY entered the home, displayed a weapon, and bound the occupants with tape. He then stole a number of items including cash, jewelry and a shotgun. In the second incident, which took place on August 31, 2001 at 58 Swinton Street in the City of Albany, CHERRY, while attempting to commit the crime of robbery, used the shotgun to gun down Ricardo Leon-Velez and Frederick Winston.
