Sentencing of Edward P. Ratcliffe III

ALBANY, NY –  District Attorney P. David Soares today announced the sentencing of Edward P. Ratcliffe III , 28, of 15 Easy Street, Troy, NY for guilty pleas to one count of Assault in the 2 nd Degree, a Class D Felony; one count of Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a Class E Felony; Leaving the Scene of an Accident, a Class E Felony; and Driving While Intoxicated as a Misdemeanor.

The Indictment alleges that the defendant, on or about June 27 th, 2004 was driving a Black Chevy S-10 on Troy-Schenectady Road while his license was suspended and while he was intoxicated. His vehicle traveled to the right of the lane markings and struck a motorcycle operated by Robert Couch resulting in major, life threatening, permanent injuries to Mr. Couch. The Indictment further alleged that the defendant left the scene of the accident leaving the victim, in terms reported by members of the victim’s family, “to die”.

The sentence handed down by Judge Breslin is five years determinant on the second degree assault charge meaning that Ratcliffe will serve 6/7ths of the sentence in jail. Judge Breslin additionally assigned post release supervision for a period of three years.

Assistant District Attorney Cheryl Fowler was very pleased with the outcome. After the sentencing, she said, “This sends a message that in Albany County, if you’re going to drink and drive, there are going to be very serious consequences.”
