DWI Case Faces 1-3 for Violating Probation

2-6 for New Charge
ALBANY , NY – District Attorney P. David Soares announced today that BRUCE FERM, 59, of 46 Wood Lake Road , Albany , NY pled guilty today to one count of Operating a Vehicle
While Under the Influence of Alcohol as a Felony. He faces 2-6 years in state prison for the charge. He will also face an additional 1-3 years for violating the terms of a sentenced handed down on January 27, of this year.
FERM was sentenced to probation and Drug Court on January 27, 2006 for a Felony DWI. He was then found off the road with his vehicle in a snow bank the very next day. When he failed a series of field sobriety tests, he was once again arrested for DWI.
“We want to provide every opportunity for chronic alcoholics to get the treatment they need,” said DA Soares, “but when defendants continue to put the public at risk by violating the terms of their probation, the only reasonable option is time in state prison. Mr. FERM will now be facing a possible 9 years for his failure to abide by the reasonable standards of civilized society.”
Sentencing on the new charge is scheduled for March 8, 2006 before the Honorable Stephen W. Herrick.
