Office of the District Attorney P. David Soares Arraignment of Sean Payton ALBANY, NY – District Attorney P. David Soares today announced the arraignment of SEAN PAYTON, 29, of 93 Herkimer Street, Albany, NY on three counts including Criminal Possession of a Controlled Substance in the 1 st and 3 rd Degrees and Criminal Possession of a Weapon in the 3 rd Degree before the Honorable Thomas A. Breslin. The Indictment alleges that at approximately 11:53 A. M. of December 23rd, 2004, PAYTON was found to be in possession of in excess of 14 ounces of crack cocaine along with an illegal handgun. The street value of the seized narcotics is estimated to be $35,000.00. The defendant was remanded to the Albany County Correctional Facility. If convicted, PAYTON faces up to 25 years in prison.
