Partnership with New York National Guard Counter Drug Task Force Leads to Second Guilty Verdict

ALBANY, NY – Albany County District Attorney P. David Soares announced today that DAMION TYRELL, 28, of Patterson, NJ, was found guilty after a jury trial before the Honorable Stephen Herrick. TYRELL faces up to 25 years when sentenced in January.

On May 25, 2007, at approximately 7:30 P.M. on Beverly Avenue, in the City of Albany, DAMION TYRELL and co-defendant NAKIA ROSE, 26, of Bronx, NY, stole approximately $2,186.00 after shooting a male victim several times. The two were later apprehended on the New York State Thruway.

When the vehicle was searched, dogs alerted Albany Police Officers to the presence of weapons, but no weapons were found. Believing there may be something hidden in the car, Albany Police Detectives reached out to the New York National Guard Counter Drug Task Force for their assistance. Utilizing their Mobile Vehicle and Cargo Inspection System (VACIS), which x-rays vehicles, members of the Task Force were able to locate a hidden compartment in the vehicle that contained two loaded 9mm pistols, cell phones and the money stolen from the victim.

“Without the cooperation and partnership of the New York National Guard Counter Drug Task Force working with the Albany Police Department, we would not be sending these dangerous men to prison. The weapons and money found in the hidden compartment of the vehicle proved beyond a reasonable doubt that they were guilty,” commented DA Soares. “I would like to thank the members of the Task Force and the jury for their service to the people of Albany County.”

TYRELL was found guilty of (1) count of Attempted Murder the Second Degree, a Class “B” Felony, (1) count of Assault in the First Degree, a Class “B” Felony, (2) counts of Robbery in the First Degree, a Class “B” Felony, (1) count of Robbery in the Second Degree, a Class “C” Felony and (1) counts of Criminal Possession of a Weapon in the Second Degree, a Class “C” Felony.

In October, NAKIA ROSE was found guilty of (1) count of Assault in the First Degree, a Class “B” Felony, (2) counts of Robbery in the First Degree, a Class “B” Felony, (1) count of Robbery in the Second Degree, a Class “C” Felony, (2) counts of Criminal Possession of a Weapon in the Second Degree, a Class “C” Felony, and (1) count of Criminal Possession of Stolen Property in the Fourth Degree, a Class “E” Felony. ROSE also faces 25 years in prison when sentenced in January.

Major Offense Bureau Chief Bruce Lennard and Assistant District Attorney Erin Reese handled the prosecution of this case.
