Office of the District Attorney P. David Soares ALBANY, NY – District Attorney P. David Soares today announced that JULIO ORTIZ, 22 of 793 Pollan Avenue, Troy, NY plead guilty to Attempted Criminal Use of a Firearm in the 1st Degree, a class "C" Violent Felony. ORTIZ's partner, ALEX RIOS, 22, of 15 Dwight Street, Brooklyn, NY plead guilty to one count of Robbery in the 2nd Degree, a class "C" Violent Felony. In pleading guilty, ORTIZ and RIOS admitted that on May 14th, 2006, at 3:45 AM in the area of 121 Madison Avenue, the defendants did steal jewelry and property from the victim by displaying a gun. Upon arrival, Police recovered the victim's jewelry and a loaded 9 millimeter Luger firearm in the backseat of Mr. ORTIZ's car. The Handgun was loaded with one round in its chamber and 6 rounds in the magazine. DA Soares stated today, "Mr. RIOS and Mr. ORTIZ are violent individuals, who had access to a dangerous firearm and caused great harm to the victim. The Residents and Business Owners who live on lower Madison Avenue have the right to feel safe in their own neighborhoods; these two individuals will have a long time to think about their crimes." Sentencing is scheduled for January 24, 2007 before the Honorable Stephen Herrick. ORTIZ faces 8 1/2 years with 3 years Post Release Supervision, RIOS faces up to 61/2 years in state prison, with 3 years Post Release Supervision. For further information contact: Rachel McEneny
