DAVID NEWKIRK Guilty of Rape

After Trial

Faces 50 Years

ALBANY, NY –  District Attorney P. David Soares announced that the first verdict in the new Albany County Judicial Building resulted in a conviction. DAVID L. NEWKIRKR 55, of Albany NY was convicted after on 6 counts including 3 counts of Rape in the 1 st Degree and 3 Counts of Sexual Abuse in the 1 st Degree after a trial before the Honorable Dan Lamont.

The jury found that NEWKIRK had repeatedly engaged in forcible rape and sexual abuse with his victim. Although the 6 counts related to incidents which took place over a one week period last May, prosecutors believed that this pattern of activity had been prolonged causing substantial damage to the victim.

DA Soares praised the courage of the young victim. “This case hinged on the testimony of the victim. No one should ever underestimate the courage required for a young person to confront their victimizer in a court of law in front of a panel of strangers. However it is my belief that not only does such testimony provide the evidence required for the conviction that will end the abuse, but the very act of testifying can help transform a victim into a survivor. I pray that this conviction helps this victim start her life anew,” DA Soares said.

NEWKIRK faces up to 25 years on each of the Rape counts but sentencing rules limit the term to a maximum of 50 years.

Sentencing is scheduled for February 26, 2006.
