Office of the District Attorney P. David Soares LIONEL CARTER A/K/A “L” FACES 9 FOR GUNS AND DRUGS CHARLES MCCALL A/K/A “Peewee Real” Faces 2 ALBANY, NY – District Attorney P. David Soares announced today that a major drug business had been shut down and that its proprietors will be going to prison. LIONEL S. CARTER, 33, of 288 Catherine Street, Albany NY pled guilty to 1 count of Criminal Sale of a Controlled Substance in the 3 rd Degree and 1 count of Criminal Possession of a Weapon. CHARLES EDWARD MCCALL, 44, of 24 Albany Street, Albany NY pled guilty to 1 count of Criminal Possession of a Controlled Substance in the 3 rd Degree. CARTER faces a total of 9 years with 3 years of post release supervision and MCCALL faces up to 2 years with 1 year of post release supervision. Both defendants entered their pleas before the Honorable Stephen W. Herrick. The indictments resulted from an investigation by the Community Response Unit of the Albany Police Department. The CRU, following up on a lead provided by a sister agency, made a number of controlled buys into a drug operation run by CARTER and operating out of an apartment leased by MCCALL. Based on the controlled buys, the CRU obtained a “no-knock” search warrant. When they entered the apartment, they saw CARTER holding a pistol which he threw into a bathtub. At the scene the CRU recovered the weapon, approximately 12.8 ounces of powdered cocaine, more than 50 grams of crack cocaine, and approximately $9500 in cash. DA Soares applauded the work of the CRU. “The amazing aspect of this arrest was that the Officers came upon the defendant holding a weapon and they managed to secure the situation without firing a shot. This kind of cool thinking takes tremendous presence of mind. The citizens of the County should be thankful that there are Officers willing to place their lives at risk in order to avoid endangering their fellow citizens,” he said.
