JONES, 23, of 247 Livingston Avenue, Albany, NY was sentenced today by the Honorable Dan Lamont to one count of Attempted Robbery in the 2 nd Degree. He received a sentence of 7 years in state prison with 1 ½ years of Post Release Supervision. Also sentenced, each to terms of 3 ½ years were SHALIMAR NELSON, 20, of 68 Watervliet Avenue, Albany, NY and MALACHI ANTONIO NELSON, 17, of 693 Clinton Avenue, Albany, NY. JONES, NELSON, AND NELSON pled guilty on October 17, 2005 to robbed a convenience store on Western Avenue on the evening of March 13, 2005. During the robbery, JONES displayed a weapon and terrorized the store owner into opening the cash register from which he removed an amount of US Currency. The two NELSONS had no previous records, supported the prosecution and did not take the lead role in the robbery. The key piece of evidence in the case was a very high quality video from a store security camera. This tape clearly showed all the key parts of the robbery including JONES entering the store, displaying a pistol, threatening the store clerk and taking the money from the cash register. Although JONES had obscured his face, both of the NELSONS were clearly identifiable from the video tape. Copies of the tape are available for review. DA Soares noted that all three defendants were arrested within 7 hours of the time of the robbery. “The Albany Police did an excellent job of tracking down these defendants and taking them into custody. Thanks to their prompt work, two foolish young men are facing 3 ½ years behind bars and Mr. JONES is facing 7”. Back to Press Releases For further information contact: Richard Arthur
