ISHMYEL PAYNE Arraigned on Murder Charge

ALBANY, NY –  District Attorney P. David Soares announced that ISHMYEL PAYNE, 15, of 72 Catherine Street, Albany, NY was arraigned today before the Honorable Thomas A. Breslin on one count of Murder in the Second Degree. If convicted he faces a sentence of 15 years to life.

The indictment alleges that on or about the 27 th day of October, 2005, at approximately 7:44 PM in front of 322 First Street, Albany NY, PAYNE caused the death of Dominique Young by shooting him in the back with a shotgun.

PAYNE was arrested on December 1 st, 2005 in Bonneau, South Carolina by a team of six Officers and Deputies of the US Marshals Service working with Sheriffs Office of Berkeley County, SC.

Despite his age, DA Soares intends to prosecute PAYNE as an adult. “This was an adult crime. It bears adult consequences,” the Soares said. “We have a gang problem and we have children not realizing that real guns cause real death and will result in real sentences in state prison. This is lesson that Mr. PAYNE is going to learn, but the lesson will come too late to do him any good,” he added.
