Office of the District Attorney P. David Soares ALBANY MAN PLEADS GUILTY TO TRUCK STOP ROBBERY ALBANY, NY – District Attorney P. David Soares today announced that JOE MONTGOMERY, 43, of 161 SECOND STREET, ALBANY, NEW YORK pleaded guilty before the Honorable Stephen Herrick in Albany County Court to (1) count of Attempted Robbery in the First Degree, a Class “C” Violent Felony, in satisfaction of a July 15, 2009, indictment charging him with (1) count of Robbery in the First Degree, (1) count of Robbery in the Second Degree, and (1) count of Petit Larceny. Montgomery admitted that on June 12, 2009, at approximately 11:28 PM at the Plaza 23 Truck Stop, at 240 Church Street in Albany, he attacked a cashier and stole several thousand dollars from cash registers. Specifically, Montgomery, armed with a wooden stick and with his head covered with a black plastic bag, burst into the Plaza 23 Truck Stop and attacked a seventy-year-old woman who was working as a cashier that evening. Montgomery repeatedly hit the woman with the stick and forcefully dragged her away from the cashier area. Eventually he shoved the victim into a walk-in cooler in the back of the store, attempting to use the stick to barricade the cooler door and prevent her escape. The victim suffered lacerations, bruises, and a broken toe as a result. Montgomery then returned to the cashier area and, using access codes he gained while previously employed at the Truck Stop, stole approximately $3000 from the cash registers. MONTGOMERY will be sentenced to 10 years in State Prison when he is sentenced on September 23, 2009. Assistant District Attorney Bradley Sherman handled the prosecution of this case.
