James King Pleads Guilty

ALBANY , NY –  District Attorney P. David Soares announced that JAMES KING, 21, of 3 Sandalwood Drive , Clifton Park , NY pled guilty today to the charge of Assault in the Second Degree before the Honorable Stephen W. Herrick.

KING entered a plea of guilty to the Indictment charging him with Assault in the Second Degree, a Class D Violent Felony. In pleading guilty, KING admitted to committing a violent felony including beating and kicking the victim while wearing boots with a reinforced toe plate. The attack, which took place between 2:00 A.M. and 3:00 A.M. of December 30th, 2004 , in the vicinity of 250 Western Avenue , left the victim with a blowout fracture of his left orbital bone, a laceration above his right eye, swelling and bruising together with substantial pain and other injuries.

DA Soares said that his Office prosecuted this crime based on the facts as presented, the law as written and precedent. “We evaluated and prosecuted this case based on the facts and circumstances of the assault,” he said.

By entering a plea to the charges against him, the sentencing is now in the hands of the court with no impact from the people other than a pre-sentencing recommendation.

If convicted, KING faces a range from 5 years probation up to7 years in prison.

Sentencing is scheduled for October 11, 2005 before the Honorable Stephen W. Herrick.
